A BILL to amend article ten, chapter eighteen-b of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section seven-c,
relating to fees collected by state institutions of higher
education; and waiving tuition and certain fees for persons
enrolled at state institutions of higher education who wish to
audit a course or class.
Be it enacted by the Legislature of West Virginia:

That article
ten, chapter eighteen-b of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
seven-c, to read as follows:
ARTICLE 10. FEES AND OTHER MONEY COLLECTED AT STATE INSTITUTIONS
OF HIGHER EDUCATION.
§18B-10-7c. Tuition and fee waivers for persons enrolled at






state institutions of higher education who wish






to audit courses or classes.
Each state institution of higher education shall permit any
person at that institution to attend its undergraduate and graduate
courses and classes for the purpose of auditing the course if
classroom space is available without charging that person any
tuition or fees, including those provided in sections two and three
of this article, if the person is enrolled at that state
institution of higher education: Provided, That the state
institution of higher education may require the person to pay
special fees, including any laboratory fees, if the fees are
required of all other students taking a single course or a
particular course, and may also require that person to pay for
parking. The governing boards of these state institutions may
propose rules for promulgation for determining the availability of
classroom space and other rules considered necessary to implement
this section, including rules regarding qualifications for
attendance, which may not exceed the qualifications required of
other persons. The rules shall provide that any person qualified
under this section are subject to being removed from the class and
replaced by a paying student who enrolls in the class if the class
would otherwise be full. The rules shall also provide for a
waiting list for students who are interested in auditing the class.
The governing boards may also extend to persons attending courses and classes under this section any rights, privileges or
benefits extended to other students, as those boards consider
appropriate.

NOTE: The purpose of this bill is to allow persons enrolled at
state institutions of higher education to audit courses or classes
without being charged tuition and certain fees.
